These Terms of Use ("Terms") govern your access to and use of mortgagenotecapital.com and related tools and communications (the "Site"), operated by Mortgage Note Capital ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Any offer or commitment to purchase a note will be made only in a separate written agreement signed by us.
3. Note purchases; we buy for our own account
Mortgage Note Capital purchases notes for its own account as a principal. Where a note does not fit our criteria, we may, only where permitted by applicable law, point you toward other note buyers. Nothing on the Site is an offer, solicitation, or commitment to buy, sell, place, or broker any note, and any transaction is governed solely by a separate, fully executed written agreement.
4. No guarantee of results
We make no representations or warranties about the accuracy, completeness, timeliness, or reliability of any content, estimate, timeline, or third-party information on the Site (including competitor details and state foreclosure data, which may change). Statements regarding closing timeframes, response times, or pricing are general expectations, not guarantees, and individual results vary. Figures describing our experience reflect the combined background of the company's principals across real estate and note transactions, and specific numbers are approximate.
5. Intellectual property
The Site and its content, design, text, graphics, logos, and compilations are owned by or licensed to Mortgage Note Capital and are protected by U.S. and international intellectual-property laws. You may view and use the Site for your own personal, non-commercial purposes. You may not copy, reproduce, republish, distribute, or create derivative works from the Site without our prior written consent.

11. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to their personal jurisdiction and venue.
12. Changes
We may modify these Terms at any time by posting the revised version with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance.
